O R D E R
This petition is to quash the impugned final report for the offence
11(2), 11(6) r/w Section 12 of POSCO Act , 2012.
2.The gist of the allegations in the final report is that the petitioner had induced the victim girls to expose their private parts by lifting their dresses on the promise of giving Rs.10/- to each and thus committed the aforesaid offences.
3.The learned Counsel for the petitioner would submit that the victim girls are aged about 11 and 9 years respectively; that the statement of one of the victim girls shows that the statement under Section 161 Cr.P.C was not recorded immediately and that there are several disputes pending between the petitioner and the defacto complainant in respect of a property.
4.The learned Additional Public Prosecutor per contra would submit that the trial has commenced and that the points raised by the petitioner cannot be adjudicated in the quash petition.
