G.Venkatachalam – Appellant
Versus
The District Collector – Respondent

Advocates:
For the Appellants/Petitioners: Mr.M.Beema Rao
For the Respondents: Mr.K.Balasubramani

ORDER

By relying on sale deed dated 24.04.1986 in favour of the petitioner's father and patta No.683, the petitioner had applied for a survey of 51 cents in S.No.57/1, K.Dharmathupatti Village.

2. At the previous hearing, after noticing that the owner of the property is the petitioner's father, I had directed the petitioner to obtain consent letters from the other legal heirs. Such consent affidavit has been filed today by also enclosing the aadhaar cards of the other legal heirs. Therefore, a case is made out to consider the petitioner's request.

3. Learned Special Government Pleader submits that an inquiry would be conducted and a decision would be taken within three months.

4 .In view of the above submissions, this writ petition is disposed of by directing the Tahsildar to conduct an inquiry in relation to the petitioner's request for survey after issuing notice to all the legal heirs of the late Govindasamy and to owners of relevant adjacent lands. Objections, if any, from the said persons shall be considered before a decision is taken. The entire process will be concluded within three months from the date of receipt of a copy of this order. No costs.
