The petitioner’s father, Noor Mohamed, had executed a gift settlement deed in favour of the Tamil Nadu government in respect of about 35 cents in survey No.205/1 for use as a pathway. On the basis that such settlement was made on condition that the petitioner's request for patta in respect of 70 cents occupied by the petitioner would be considered, the petitioner had submitted a representation seeking grant of patta.
2. Learned counsel for the petitioner submits that the petitioner's request is pending consideration by the District Collector and that reports have been called for from the subordinate revenue officials.
3. Learned Additional Government Pleader accepts notice for all the respondents. He points out that the settlement deed does not make any reference to an exchange of land. Without prejudice, he submits that the petitioner's request would be considered and disposed of by the District Collector within three (3) months.
4. Accordingly, without making any observations on the merits, this Writ Petition is disposed of by directing the District Collector to consider and pass orders on the petitioner's request within three (3)
