The petitioner seeks a direction to the 5th respondent to disburse the amounts, that have been retained by him.
2. The petitioner is a Contractor. He participated in a Tender for construction of wholesale and retail shop at Gandhi Market under the 5th respondent. He completed the work. In terms of the Contract, 2.5% of the total amount was to be retained as Retention Amount. In addition, a sum of Rs.3 lakhs was retained as deposit. The amounts had to be refunded two years after completion of the contract.
3. The petitioner states that on 18.08.2016, he handed over the shops to the 5th respondent. Despite the lapse of two years, the amounts retained had not been refunded. Hence he has made a representation on 12.09.2025 seeking refund of a sum of Rs.17,99,850/-.
4. When the matter came up for admission, Dr.T.Seenivasan representing R1 to R5 has produced instructions from the 5th respondent. The instructions are scanned and extracted hereunder:-
