Eviction under tenant laws requires adherence to agreements; revisions dismiss due to lack of merit.

Headnote:This judgment concerns a revision under Article 227 of the Constitution against a decree of eviction by the Rent Controller under the Tamil Nadu Regulation of Rights and Responsibilities of Landlords and Tenants Act, 2017, particularly invoking Section 21(2)(a) for failure to enter into a rental agreement (paragraph 2). The court framed the issue of whether the tenant had a rightful claim against the maintaining of eviction orders despite the concurrent findings of lower courts (paragraphs 3-4). Consequently, the revision is dismissed, granting the tenant until 31.03.2026 to vacate the premises peacefully (paragraphs 6-8).

ORDER

The unsuccessful tenant in a proceeding arising out of Tamil Nadu Regulation of Rights and Responsibilities of Landlords and Tenants Act, 2017 is the revision petitioner.

2.The respondent/landlord sought for eviction of the revision petitioner invoking Section 21(2)(a) of TNRRRL Act alleging that there has been failure to enter into an agreement under Section 4(2) of the Act.

3. The Rent Controller ordered eviction and the appeal preferred by the revision petitioner before the Tribunal was also dismissed. Challenging the concurrent findings, the present revision has been filed.

4. After heaering the counsel for the revision petitioner and finding that there is no merit in the revision, I was inclined to dismiss the revision and at that point of time, learned counsel for the petitioner has sought for some time to enable the petitioner to vacate and hand over vacant possession.

5. Today, an affidavit of the petitionier has also been filed, in and by which, the revision petitioner has undertaken to vacate the premises on or before

31.03.2026 and also pay the rents regularly till such time he vacates the premises.

6. Therefore, it would suffice to record the undertaking filed by the revision petitioner. Therefore, the civil revision petition is dismissed granting time till 31.03.2026. The petitioner shall have time till 31.03.2026 to vacate the premises peacefully, without any arrears of rent and without driving the respondent to executioin proceedings.

7. It is also made clar that the petitioner shall not induct any third party into possession till such time he vacates and hand over vacant possession.

P.B.BALAJI, sr

8. The civil revision petition is dismissed. No costs. Consequently, connected miscellaneous petition is closed.
