IN THE HIGH COURT OF JUDICATURE AT MADRAS
SENTHILKUMAR RAMAMOORTHY, J
Arunpandi – Appellant
Versus
The Thasildar, Singampunari Taluk, Sivagangai District – Respondent
O R D E R
By relying on a sale deed dated 06.05.2025 and patta No.71 in the name of Amudharani, the petitioner had applied for patta transfer under Section 10 of the Tamil Nadu Patta Passbook Act , 1983.
2. Learned Government Advocate accepts notice for the sole respondent. He submits that an inquiry would be undertaken and orders would be passed on merits within three (3) months.
3. The sale deed dated 06.05.2025 reveals that the petitioner purchased the property from one Vanitha, who, in turn, purchased the property from one Thirugnanam. There is no reference to the pattadar Amudharani in the petitioner's sale deed. Learned counsel for the petitioner, however, submits that Thirugnanam purchased the property from Amudharani. This aspect has to be examined by the Tahsildar before a decision is taken.
4. Subject to the above observations, this Writ Petition is disposed of by directing the respondent to consider the petitioner's request for patta transfer and issue orders therein within three (3) months from the date of receipt of a copy of this order after providing a reasonable opportunity to the petitioner and any other persons who would be affected by such order. No costs.
