The petitioner, who is presently a resident of Chennai, has filed this public interest litigation, seeking action against respondents 7 and
8 on the allegation that patta has been illegally granted to them. 2. Learned State Counsel would submit that the petitioner has a remedy of filing an appeal under Section 12 of the Tamil Nadu Patta Pass Book Act , 1983. The petitioner has preferred a representation and if the Court permits, the same shall be treated as an appeal and it would be appropriately decided.
3. Learned counsel for respondents 7 and 8 would submit that the petitioner has no concern whatsoever with the property in dispute and he is staying in Chennai and has filed this petition in respect of a property which is situated in Salem District.
4. Be that as it may; taking into consideration that representation has been given to the authority concerned regarding the alleged grant of patta in an illegal manner, it should be treated as an appeal under Section 12 of the Tamil Nadu Patta Pass Book Act and appropriate inquiry should be made and an order passed after affording an opportunity of hearing to all the parties.
