The petitioner, after his superannuation on 30.06.2007, claimed arrears of salary from 01.07.2007 to 31.12.2007 by treating the said working period as continuity of service by fixing the petitioner’s retirement on
31.12.2007 and by seeking payment of continuity of service benefits etc., 2. The respondents 2 to 5 have filed a counter affidavit stating that the petitioner retired from service on 30.06.2007 and that, as such, there existed no Employer – Employee relationship thereafter and therefore, he is not entitled to claim salary for the said period.
3. The order sheet reveals that there has been no representation for the petitioner either in person or through counsel on several occasions.
4. Today, when the matter is taken up for hearing, there is no representation for the writ petitioner either in the physical Court or on videoconferencing platform.
5. In view of the above, captioned Writ Petition is dismissed for default / non-prosecution. No costs.
