Respondents Prayer: This Writ Petition (Criminal) has been filed under Article 226 of the Constitution of India, seeking to issue Writ of Certiorarified Mandamus to call for the records No.NIL, dated 16.05.2025 passed by the second respondent and quash the same and consequently direct the second respondent to grant 28 days ordinary leave to the petitioner's son Venkatesan, S/o Chinnaraj, aged 37 years, convict prisoner No.1732 (PID 457593) now confined in the Central Prison-I, Puzhal, Chennai - 66.

ORDER (Order of the Court was made by P.VELMURUGAN, J.)

This writ petition has been filed to quash the order dated 16.05.2025 passed by the second respondent and consequently to direct the second respondent to grant 28 days ordinary leave to the petitioner's son, Venkatesan, S/o Chinnaraj, aged 37 years, Convict Prisoner No.1732, (PID 457593), confined at Central Prison-1, Puzhal, Chennai-66.

2 Heard the learned counsel on either side and perused the documents.

3 The petitioner herein seeks grant of 28 days of ordinary leave for her son, who is the life convict, without escort, on the ground that the convict prisoner has two school going children and his wife also died. The petitioner, who is the mother of the convict prisoner, facing financial crisis to take care of the two children. Further, the convict prisoner has undergone 8-1/2 years of imprisonment.

4 The learned Additional Public Prosecutor would submit that on an earlier occasion, when the convict prisoner was granted ordinary leave, he had absconded and was recaptured after 10 years and hence the second respondent rejected the petitioner's request to grant leave to the prisoner.

5 Considering the grounds taken by the petitioner, this Court is inclined to grant ordinary leave for 10 days with necessary escort, since the convict prisoner violated the conditions, on the earlier occasion.

6 Accordingly, the convict prisoner viz., Venkatesan, S/o Chinnaraj, aged 37 years, Convict Prisoner No.1732, (PID 457593), confined at Central Prison-1, Puzhal, Chennai-66, is hereby granted leave for a period of 10 days, with necessary escort, commencing from 10.00 am on 16.12.2025 to 5 pm of 25.12.2025. On expiry of the ordinary leave, the convict prisoner shall surrender before the prison authorities. The second respondent is directed to provide necessary escort to the convict from the Central Prison from the time he leaves the prison and till such time he is taken back to the prison. It is made clear that the convict prisoner shall utilize the leave only for the purpose for which it has been granted and shall not indulge in any unlawful activities.

Further the convict prisoner shall bear the expenses of one escort.

7 With the above directions, this Writ Petition stands disposed of. Consequently connected miscellaneous petition stands closed.
