Grade Vacancies as Tech Gr.III dated 30.11.2022 and quash the same and direct the respondents to adhere to the Reservation on promotion for the persons with benchmark disabilites as per the provisions of the Rights of Persons with Disabilities Act, 2016, and Memorandum of the Railway Board in RBE No.74/2022 in No.E(NG) I/2019/PM 4/8 dated 01/07/2022 and allot/earmark seats for those persons, who are serving in the Department with benchmark disabilities and grant such other further relief.

ORDER

This writ petition has been filed to call for the records of the

6th respondent in connection with the impugned Notification No.EPB/533/Hr. Grade Vacancies as Tech Gr.III dated 30.11.2022 and quash the same and direct the respondents to adhere to the Reservation on promotion for the persons with benchmark disabilites as per the provisions of the Rights of Persons with Disabilities Act, 2016, and Memorandum of the Railway Board in RBE No.74/2022 in No.E(NG) I/2019/PM 4/8 dated 01/07/2022 and allot/earmark seats for those persons, who are serving in the Department with benchmark disabilities

2. When the matter was taken up for hearing today, the learned counsel for the petitioner produced before this Court, a copy of the communication dated 21.01.2023 issued by the fourth respondent wherein it is stated that the impugned order dated 30.11.2022 stands withdrawn due to administrative reasons.

3. In view of the above submission made by the learned counsel for the petitioner, nothing survives for consideration of this Court in this matter and therefore, this Writ petition is dismissed as infructuous. No costs.
