The Writ of Habeas Corpus Petition has been filed seeking a direction to respondents 1 and 2-Police to produce the petitioner’s daughter, Ishwarya, aged about 18 years, who is alleged to be in the illegal custody of the third respondent, before this Court and to handover her custody to the petitioner.
2. When the matter was taken up for hearing, today, the respondents-
Police, secured and produced the detenue, Ishwarya, aged 18 years, before this Court. On enquiry, the detenue stated that she is in love with the third respondent, who is her senior in the institution, where she is studying, and that she has already attained the age of 18 years. She further stated that since her parents did not agree to her marriage with the third respondent and had arranged her marriage with another person, she left her parents home, went to the third respondent, and married him. She also expressed her willingness to go with the third respondent.
3. Further, on enquiry, it was found that the third respondent has not attained the age of 21 years. However, the parents of the third respondent are present before this Court and have given an undertaking that they will take care of both the detenue and the third respondent.
4. In view of the same, this Habeas Corpus Petition stands closed.
