ORDER

This writ petition is filed for direction to the 1st, 2nd and 3rd respondents to inspect Sri Balaji Higher Secondary School, Nallur, Cuddalore and find if there is a violation of rules, procedures and norms and order to cancel the Certificate of Recognition of said School, within a time limit that may be stipulated by this Court.

2. Mr.M.Abivarthan, the learned Counsel appearing on behalf of the petitioner would submit that the school firstly lacks even the minimum required extent and other facilities. Secondly, he would submit that the lands are still classified as agricultural lands and even as per Chitta, it can be seen that paddy crop is being raised in the said lands; the same is wrongly shown as the ground and recognition is obtained. Thirdly, there is also a dispute with reference to the entire extent that is shown to the education Authorities; the property belongs to the joint family and also some third parties. By wrongly arrogating title, the trustee namely Mr.Anbukumaran, has obtained the certificate fraudulently. For all the above reasons, the learned Counsel would pray that the respondents should be directed to conduct an enquiry in the matter.

3. I have considered the submissions made by the learned Counsel for the petitioner and considered the affidavit and also the documents that are filed on behalf of the petitioner.

It can be seen that the school namely Sri Balaji Higher Secondary School, bearing Reg.No.61144/W4/E3/2020 was originally bought by the petitioner’s father Mr.N.Arivanandham and thereafter, it is seen that Mr.Anbukumaran, the brother of the petitioner has taken over as a correspondent and relieved the petitioner from the said post. Therefore, what is lacking is the love and bonding between the brothers and not the other things. Secondly, it can be seen that when so many allegations are made against the correspondent and the school, the school is not made as a party. Thirdly, when the petitioner as a brother is having the civil dispute, it is not for him to raise all the other grounds relating to the lack of infrastructure etc,. If any student or a parent interested in the matter of education complaints, the same can be looked into by the Court. When the grievance of the petitioner seems to be a dispute within the family and with reference to the management, it is for the petitioner to file a civil suit, if he lawfully feels that he should be in the management. If the petitioner lawfully feels that some part of the property belongs to him, again he should only file the civil suit. Dragging the education Authorities into the family dispute is absolutely uncalled for.

5. Accordingly, finding no merits, the Writ Petition stands dismissed. No costs.
