PRAYER; This writ petition is filed under Article 226 of Constitution of India, to issue a Writ of Mandamus, to direct the respondents to consider and dispose of petitioner representation dated 14.02.2025 to grant petitioner notional or retrospective seniority from the year 2019 onwards on par with the officers who were included in the 2019 C-List to ensure petitioner eligibility for promotion as as Inspector or to include petitioner name in the C list and grant him promotion as a Sub Inspector (local ) with notional or retrospective seniority within a timeline fixed by this Honble court.

ORDER

This petition has been filed seeking a direction to the respondents to consider and dispose of petitioner representation dated 14.02.2025 to grant petitioner notional or retrospective seniority from the year 2019 onwards on par with the officers who were included in the 2019 C-List to ensure petitioner eligibility for promotion as as Inspector or to include petitioner name in the C list and grant him promotion as a Sub Inspector (local ) with notional or retrospective seniority within a timeline fixed by this Honble court.

2. It is the case of the petitioner that he appointed as Grade II Police Constable on 24.05.1999 and subsequently, he was upgraded to the post of Head Constable in the year 2014. In the year 2018, the petitioner was currently serving as Special Sub Inspector of Police. While the petitioner was working as a Head Constable under the third respondent, the first respondent issued memorandum in on 25.04.2019 with the instruction to prepare a ‘’C’’ list for the year 2019 pertaining to the promotions of Head Constables and Special Sub Inspectors (Local) as sub Inspector of Police (Local). In view of the above, the petitioners name was not shown. Hence, the petitioner made a representation to the respondents 1 to 3 to grant him a notional or retrospective seniority from the year 2019 onwards on par with the officers who were included in the 2019 C – list to ensure his eligibility for promotion as an Inspector or to include his name in the C List. However, no action was taken by the respondents till date. Hence, the present writ petition.

3. The learned counsel for the petitioner submitted that this Court may direct the respondents to consider and pass orders on the petitioners representation within the stipulated time as fixed by this Court.

4. The learned Government Advocate appearing for the respondent submitted that the representation will be considered and orders will be passed within the stipulated time as fixed by this Court.

5. Heard the learned counsel for both side and perused the materials available on record.

6. Considering the facts and circumstances of the case and in view of the limited request sought for by the petitioner, this court directs the 3rd respondent to consider and pass orders on the petitioner's representation dated 14.02.2025 within a period of four weeks from the date of receipt of a copy of this order.

7. With the above directions, the writ petition is disposed of. No costs.
