For Petitioner : Dr.R.Gouri For Respondent-1 : Mr.M.R.Gokul Krishnan, AGP For Respondent-2 : Mr.S.C.Kathiravan, Standing Counsel O R D E R The present Writ Petition has been filed seeking a direction to the second respondent to include the name of the petitioner and call her for Certificate Verification in pursuance to the Notification No.02/2025 dated 10.07.2025 under the reservation earmarked for Secondary Grade Teachers (SGTs) for the post of Post Graduate Assistant Mathematics in the Tamil Nadu Higher Secondary Education Service, 2025.

2. Heard both sides. With the consent of both sides, the Writ Petition is taken up for final hearing today at the admission stage itself.

3. The brief facts of the case is as follows:

3.1. The petitioner herein applied for appointment to the post of Post Graduate Assistant called for by the second respondent through notification No.02/2025 dated 10.07.2025 and has secured 87 marks in the written examination and has been declared qualified. She belongs to B.C. Muslim category and under the Rule of Reservation, Vertical Reservation mandates for 3.5% for BC Muslims and Horizontal Reservation mandates that 8% vacancies has to be filled from among the qualified SGTs and other teachers with secondary grade scale of pay working in Government Higher Secondary Schools as contemplated in the notification. The petitioner herein is fully qualified and having 18 years of teaching experience including SGT posts. While that being so, the petitioner having secured 87 marks and declared qualified, has not been called for the certificate verification under the reservation earmarked for SGTs in the current vacancies.

4. Aggrieved over the same, the petitioner has come forward with the present Writ Petition.

The learned counsel for the petitioner submitted that the petitioner having secured 87 marks and being declared as qualified, has not been called for certificate verification by the second respondent. She submitted that the respondents have not followed the reservation quota for BC (M). She further submitted that the petitioner has made a representation through online on 02.12.2025 in regard to the same, however, there was no response. Hence, the present Writ Petition.

Per contra, the learned counsel appearing on behalf of the second respondent submitted that as per the notification, 8% reservation seats were allocated only to Backward Classes category viz., BC SGT-2; BC W SGT-1; and BC T SGT-1, for which 8 candidates under BC Category were called for certificate verification and no seats were allocated to BC Muslim and hence, the claim of the petitioner itself is not maintainable. He further submitted that the petitioner can be considered only under GT, GT W, GT SGT, BCM and BCM W categories, in which she did not fall within the zone of consideration. He added that however, the petitioner shall make a representation in this regard and the same may be considered by the respondent on merits and in accordance with law.
