By consent, the writ petition is taken up for final disposal at the admission stage itself.
2.The petitioner has filed this writ petition seeking issuance of Writ of Mandamus directing the respondents to grant the petitioner’s pay and post party on par with his juniors in the post of Accountant, Superintendent, Assistant, Accounts Officer, Accounts Officer, Chief Accounts Officer and finally to the post of Joint Director retrospectively with consequential fixation of pay and revision of retirement benefits and pensionery benefits.
3.The learned counsel appearing for the petitioner submitted that the petitioner was appointed as Junior Assistant in Sub Treasury at Ottapidaram during the year 1985 and retired as Chief Accounts Officer in the Office of the Commissioner of Treasuries and Accounts, Chennai on 30.04.2025 on attaining the age of superannuation. The learned counsel further submitted that if the petitioner’s name had been included in the promotional panels on par with his juniors, he would have retired as Joint Director. Hence, the petitioner made representation dated 18.09.2025 requesting the respondents to grant pay and post party on par with his juniors in the post of Accountant, Superintendent, Assistant, Accounts Officer, Accounts Officer, Chief Accounts Officer and finally to the post of Joint Director retrospectively with consequential fixation of pay and revision of retirement benefits and pensionery benefits, however, there is no response.
4.The learned counsel appearing for the petitioner further submitted that this Court may without going into the merits of the case, issue direction to the respondents to consider the petitioner's representation dated 18.09.2025 and to pass appropriate orders, within a reasonable time frame.
5.Perusal of records reveal that on 28.02.2011, panel for promotion to the post of Assistant Accounts Officer in Class IV of Tamil Nadu State Treasuries and Accounts Services for the year 2010 – 2011 was drawn by the respondents, in which, Cheranthian’s name was in serial no.23 and the petitioner's name was in serial no.63. The petitioner without challenging the panel for promotion to the post of Assistant Accounts Officer in Class IV dated 28.02.2011, has made representation to the respondents, after retirement, to grant pay and post party on par with his juniors in the post of Accountant, Superintendent, Assistant, Accounts Officer, Accounts Officer, Chief Accounts Officer and finally to the post of Joint Director retrospectively with consequential fixation of pay and revision of retirement benefits and pensionery benefits, which is not sustainable one.
6.The writ petition is dismissed. No costs.
