O R D E R

This Writ Petition has been filed seeking for a direction to the second respondent to survey the petitioner's land to an extent of 1425 square feet comprised in Survey Field No.108/2 Old T.S.No.330/1 of 2^nd Ward, Dindigul Town, Dindigul District and to fix its boundaries as per revenue records and to lay boundary stone by obtaining adequate police protection from the respondents 3 & 4 to conclude the survey within a stipulated time as fixed by this Court.

2. Both parties are present and by considering their arguments, this Writ Petition is disposed of at the admission stage itself.

3.The learned counsel appearing for the petitioner would submit that online application has been made for demarcation of the boundaries of the property in question. Pursuant to the same, notices were issued for survey on 09.04.2025 and 06.08.2025 to the persons interested including the fifth respondent.

4.According to the learned Counsel for the petitioner and the official respondents, the fifth respondent prevented the officials from conducting the survey.

5.Earlier, when this Writ Petition was taken up for hearing, the fifth respondent sought time to file counter. This Court has given time for filing counter, but on the next date of hearing, the learned Counsel for the fifth respondent was absent and hence, as a final chance, the case has been listed today. However, no counter affidavit has been filed by the fifth respondent till date. Having received the notice, the fifth respondent can only put forth his grievance and cannot stop the public servants from conducting the survey in accordance with the procedures.

6.In view of the above, this Court directs the official respondents to undertake the survey and demarcate the land of the petitioner, after giving notice to the parties concerned including the fifth respondent and after consideration of the claims of both the parties and pass orders in accordance with Sections 9 and 10 of the Tamil Nadu Land Survey and Boundaries Act, 1923, within a period of eight [8] weeks from the date of receipt of a copy of this order. In the event of any obstruction by the private respondent, the official respondents shall take the assistance of the jurisdiction police for conducting survey.

7.With the above direction, this Writ Petition stands disposed of.

There shall be no order as to costs.
