ORDER
Heard both sides.
2.The writ petitioner wants to deal with the petition mentioned property. However, she is unable to do so because the Tamil Nadu Housing Board has written to the registering officer that they should not entertain any document pertaining to the petition mentioned property. According to Tamil Nadu Housing Board, the petition mentioned property was acquired long back. Challenging the communication of the Tamil Nadu Housing Board, this writ petition has been filed.
3.The learned counsel for the petitioner draws my attention to the order dated 14.09.1995 in W.P.No.12508 of 1995. The writ petitioner therein was none other than the husband of the writ petitioner. Challenge was mounted against the notification issued under Section 4 of the Land Acquisition Act. The writ petition was allowed.
4.The Tamil Nadu Housing Board is not able to place any material to show that this order was put to challenge in a writ appeal and reversed. I, therefore, have to proceed on the premise that the said order dated
14.09.1995 is holding good.
5.The respondents had taken notice on 24.10.2025 and it was made clear that this writ petition will be taken up for final disposal on 28.11.2025 ie., today. Today, when the matter was taken up for hearing, the respondents take a stand that they will have to verify the records. I am not inclined to grant them further time.
6.The writ petitioner is a 78 years old senior citizen. When the order dated 14.09.1995 in W.P.No.15208 of 1995 is holding the field and the proceedings stand quashed, it is not open to the Tamil Nadu Housing Board to insist that documents pertaining to the petition mentioned property should not be registered. The impugned communication is quashed insofar as the petition mentioned property concerned. If the petitioner presents any document relating to it, the registering officer is bound to entertain the same.
7.This writ petition is allowed on these terms. No costs.
Consequently, connected miscellaneous petition is closed.
