Mr. Ramesh Ganapathy, learned counsel for the first respondent, submits that a letter has been addressed by the first respondent viz., Mahendra Pratap Singh, to the Registrar, Madras High Court, Chennai-104 stating that, he is the proprietor of M/s.Sri Balaji Associates & Logistics and he has agreed for the removal of the mark SODHAKAR in Class 17 under Application No.6322916. In the letter, it is further stated that due to his old age, he could not come to attend the Court in person and that he has authorised his counsel Mr.Ramesh Ganapathy of M/s.Mission Legal to represent his case. The scanned copy of the undertaking is extracted hereunder:
