PRAYER: Civil Revision Petition filed under Article 227 of Constitution of India to set aside the Order in IA.No.06 of 2025 in OS.No.98 of 2022 dated
13.08.2025 passed by the learned Additional District Munsif Tiruvallur.
For Petitioner(s): M/s.A.Prem Sandhya for Mr. R.THANIGAI ARASU
ORDER
This civil revision petition is filed, challenging the order passed by the Trial Court, dismissing the application filed by the petitioner/defendant seeking issuance of summons to the Tahsildar, Thiruvallur for production of SLR copy concerning the suit property.
2. The respondent/plaintiff filed a suit in O.S.No.98 of 2022 seeking permanent injunction restraining the petitioner/defendant from interfering with her alleged possession of the suit property. In the suit, already trial commenced and the same is posted for recording further evidence on the side of the petitioner/defendant. At this stage, the petitioner filed the instant application to issue summons to the Tahsildar for production of revenue records pertaining to the suit property. The said application was dismissed by the Trial Court.
Aggrieved by the same, the petitioner has come before this court.
3. The learned counsel for the petitioner would submit that the respondent claimed right over the suit property, however, the subject property is a government land and in order to prove the same, the concerned Tahsildar shall be summoned for producing the revenue records. If the petitioner wants to produce the revenue records concerning the suit property, it is for her to get the certified copy of the documents from the Revenue Department and produce the same before the court. When the petitioner has got remedy of filing certified copy of the document before the Trial Court, the concerned revenue officials cannot be summoned for production of documents, pertains to the suit property. The Trial Court rightly came to the conclusion that the application filed by the petitioner seeking issuance of summons to the Tahsildar is unnecessary and I do not find any error in the said order to interfere the same.
4. Accordingly, this civil revision petition is dismissed. There shall be no order as to costs. Connected miscellaneous petition is closed.
