O R D E R

The present Criminal Original Petition has been filed seeking transfer of investigation from the file of the first respondent to any other competent agency and to direct the third respondent to monitor the investigation.

Learned counsel appearing for the petitioner submitted that the petitioner’s husband died under mysterious circumstances while working at the house of one Sankaran, a retired Deputy Commissioner of Police. He further submitted that the petitioner is not a witness to the occurrence, however, she was made to sign in a plain paper and a complaint was prepared as if her husband was suffering from epilepsy, due to which, he had fallen from the sunshade. He also submitted that the respondent Police are trying to cover up the entire case due to the influence of the retired Deputy Commissioner of Police, Sankaran. Therefore, the present petition has been filed seeking transfer of investigation.

Learned Government Advocate (Criminal Side) submitted that the complaint does not say that the petitioner witnessed the occurrence and the fact remains that the petitioner’s husband had gone along with one Vinayagam, on whose information, the petitioner lodged the complaint. Based on her complaint, a case in Crime No.396 of 2025 was registered on the file of the first respondent Police under Section 194 BNSS, in which investigation is proceeding in the proper line. He also submitted that the preliminary investigation reveals that the petitioner’s husband, while working on the sunshade, fell due to epilepsy and died owing to the injuries sustained. He further submitted that the final opinion from the Forensic Lab is awaited and that the respondent Police are conducting the investigation fairly without any influence.

Having heard the learned counsel appearing on either side and upon perusal of the materials available on record and taking note of the allegations made by the petitioner regarding the investigation, this Court directs the second respondent, the Deputy Commissioner of Police, Tambaram, to monitor the investigation. The investigation shall be completed and the final report shall be filed within a period of two months from today.

5. With the above directions, this Criminal Original Petition stands disposed of.
