PRAYER:-Writ Petition filed under Article 226 of the Constitution of India, praying for an issuance of Writ of Certiorarified Mandamus, calling for the records relating to the impugned Refusal Check Slip in RFL/ Pollachi/ 32/ 2025 dated 18.07.2025 on the file of 1st respondent, quash the same and consequently direct the 1st respondent to register the Settlement deed dated 18.07.2025 to be represented by the petitioner and return the same after completion of registration formalities.

ORDER
This writ petition has been filed by the petitioner challenging the impugned Refusal Check Slip in RFL/ Pollachi/ 32/ 2025 dated 18.07.2025 issued by the 1st respondent.
2.Learned counsel for the petitioner would submit that the petitioner intend to settle the land measuring to an extent of 0.38 acres in S.F.No.114/5 and the land measuring to an extent of 0.62 acres in S.F.No.110/A situated at Singanallur Village or Anaimalai Taluk, Coimbatore District, in favour of her sister by virtue of the settlement deed dated 18.07.2025. However, when the said settlement deed was presented for registration before the 1st respondent, the same came to be rejected on the ground that the 2nd respondent has filed an obstruction petition to register the subject property. Hence, the present writ petition has been filed.
3.Learned counsel for the 2nd respondent has filed a counter stating that the 2nd respondent has no objection to register the settlement deed dated 18.07.2025 in respect of the property comprised in S.F.No.110/A and 114/5 situated at Singanallur Village or Anaimalai Taluk, Coimbatore District, executed by the petitioner in favour of her sister. He would further submit that the 2nd respondent was under the impression that the petitioner is going to settle the property comprised in S.F.No.110/C and therefore, he filed an obstruction petition.
4.Learned Government Advocate appearing for the 1st respondent would submit that in the event, the petitioner re-presented the settlement deed dated
18.07.2025, the same will be considered.
5.Heard the learned counsel for the petitioner; the learned Government Advocate appearing for the 1st respondent and the learned counsel for the 2nd respondent and perused the materials available on records.
6.Considering the submissions made by either parties, it is evident that the 2nd respondent has made an objection for registering the settlement deed dated 18.07.2025, executed by the petitioner under the wrong impression that the petitioner is settling the property comprised in S.F.No.110/C. However, the 2nd respondent has filed a counter stating that he has no objection for registering the settlement deed in respect of the properties comprised in S.F.No.110/A and 114/5, executed by the petitioner in favour of her sister. Such being the case, the 1st respondent is directed to verify the aspect of survey numbers specified in the settlement deed dated 18.07.2025 and register the settlement deed dated 18.07.2025, if it is otherwise in order, immediately upon the re-presentation of the same.
7.With the above directions, this writ petition is disposed of.
