ORDER
This writ petition has been filed for the following relief :
“directing the respondents herein to initiate immediate action for public auction about the Kadambakulam Tank, Thoothukudi District in the light of the Notification issued by the 2nd respondent vide Na.Ka.no.19310/F4/2021 dated 22.12.2021 based on the petitioner's representation dated 10.10.2022 and
05.12.2022.”
2. The case of the petitioner is that the 2nd respondent issued a notification in Na.Ka.No.19310/F4/2021, dated 22.12.2021 regarding fishing rights. In the said notification, all the District Collectors were informed that in future, fishing rights shall be granted only through public auction. However, there is no action on the side of the respondents 3 and 4 to the said effect. Therefore, the petitioner sent a representation dated 10.10.2022 to the respondents 1 and 2 to initiate immediate action for public auction. Pursuant to the same, the 2nd respondent issued a communication dated 21.10.2022 informing that the public auction of the Kadambakulam fishing rights is pending consideration before the Government. Thereafter, the petitioner submitted another representation to the 3rd respondent on 05.12.2022 seeking the same relief, which was forwarded to the 4th respondent. The 4th respondent, by communication dated 29.12.2022, reiterated the very same position that had earlier been conveyed by the 2nd respondent in his reply dated 21.10.2022. Seeking immediate action, the petitioner is before this Court.
3. Heard the learned counsels on either side.
4. Without going into the merits of the case, this Court directs the respondents to consider the representations of the petitioner, dated
10.10.2022 and 05.12.2022 and pass orders, in accordance with law, after affording an opportunity of personal hearing to the petitioner. The said exercise shall be completed within a period of two (2) months from the date of receipt of copy of this order.
5. With the above directions, this Writ Petitions stands disposed of.
No costs.
