ORDER

This Writ Petition has been filed directing the first respondent to dispose the miscellaneous petition in AP No.74 of 2019, application to a vacate the interim order of Status Quo, within the time frame fixed by this Hon'ble Court.

2. Heard Mr.E.Ganesh, learned counsel for the petitioner and Mr.K.Karthikeyan, learned Government Advocate for the respondent 1 and 2.

3. The case of the writ petitioner is that the petitioner and the petitioners'

community persons have been traditionally administrating four temples at Naduvacheri Village, Avinashi Taluk, Tiruppur District. The temples are governed by the scheme framed by the Joint Commissioner, Hindu Religious and Charitable Endowments Department in OA No.9 of 2004 wherein according to the petitioner, the communities right to administer the four temples have been recognised. However, the respondents 3 and 4 in the present writ petition has filed an appeal, which according to the writ petitioner is time barred. The said appeal is pending in AP No.74 of 2019 before the first respondent. The first respondent also granted an order of Status Quo, which is working serious action prejudice to the writ petitioner. The writ petitioner has sought for expeditious disposal of the miscellaneous petition filed by the writ petitioner to vacate the interim order of Status Quo and seeks for necessary direction in this regard.

The learned Government Advocate, on instructions, submitted that pending the appeal in AP No.74 of 2019 an interim order of Status Quo has been granted by the commissioner, Hindu Religious and Charitable Endowments Department and the petitioner has, as claimed taken out an application to vacate the said interim order of Status Quo. He would further state that the said application to vacate the order of status quo shall be taken up on merits and disposed of within a period of four weeks from the date of receipt of a copy of this order.

5. Recording the said submission of the learned Government Advocate, this Writ Petition is disposed of, directing the first respondent to dispose of the vacate stay petition filed by the petitioner within a period of four weeks from the date of receipt of a copy of this order. No costs.
