Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, to accept to register the Sale Deed pending Document no . ORDER

This writ petition has been filed to direct the respondents to accept to register the sale deed dated 15.09.2025 and subsequently, to consider the petitioners' representation dated 09.10.2025

2. Mr.M.R.Gokul Krishnan, learned Additional Government Pleader, takes notice on behalf of the respondents.

3. By consent of the parties, the main writ petition is taken up for disposal at the admission stage itself.

4. The learned counsel for the petitioner would submit that in this case, though the petitioner had presented the sale deed dated 15.09.2025 and also obtained token for the purpose of registration, no steps were taken by the respondents to register the said sale deed. In this regard, a representation dated 09.10.2025 was also filed by the petitioner. However, the same was not at all considered by the respondents till date.

Hence, this petition.

5. In reply, the learned Additional Government Pleader appearing for the respondent would submit that the respondents will take decision with regard to the registration of petitioner’s sale deed at the earliest.

Hence, he requests this Court to pass appropriate orders.

6. Heard the learned counsel for the petitioner and the learned Additional Government Pleader for the respondents and also perused the entire materials available on record.

7. In the case on hand, the petitioner had presented his sale deed dated 15.09.2025 for the purpose of registration before the respondents. However, the said sale deed was not at all registered by the respondent and it was kept pending for a period of 2 months without assigning any proper reason.

8. Further, when this Court questioned with regard to the delay in registration process, the learned Additional Government Pleader appearing for the respondent was not in a position to provide any reason for the said delay. That apart, as on date, no objection was received, in respect of the petitioner’s sale deed, from any other concerned/aggrieved parties. When such being the case, there is no impediment for the respondents to register the sale deed presented by the petitioner. In spite of the same, the process of registration was delayed by the respondents only for the reasons better known to them and the same cannot be accepted.

9. In view of the above, this Court directs the respondents to register the petitioner’s sale deed dated 15.09.2025 within a period of 48 hours from the date of receipt of a copy of this order.

10. With the above directions, this writ petition is disposed of. No cost.
