ORDER

This Writ Petition has been filed directing the second respondent to conduct enquiry in OA. No.7 of 2024, giving full opportunity to the petitioner.

2. Heard Mr.Abdul Wahab, learned counsel for the petitioner and Mr.K.Karthikeyan, learned Government Advocate for the respondents.

3. The petitioner has made an application under Section 63(b) of the Tamil Nadu Hindu Religious and Charitable Endowments Act to the Joint Commissioner, who is the second respondent, claiming declaration of his hereditary right to administer the Mutt. In the mean time, the RP proceedings have been initiated and fit person has been appointed in RP No.426 of 2024. The writ petitioner challenged the appointment of the said proceedings before this Court and this Court in W.P.No.24383 of 2024 dismissed the writ petition, giving liberty to the petitioner to approach the revisional authority under Section 21 of the Hindu Religious and Charitable Endowments Act. According to the petitioner, the said revision under Section 21 of the Hindu Religious and Charitable Endowments Act had also been filed and the same is pending. Citing pendency of the said revision, the petitioner's application under Section 63(b) of the Act is put in cold storage. Hence the petitioner has come forward in the present writ petition seeking expeditious disposal of OS No.7 of 2024 before the second respondent.

4. Mr.K.Karthikeyan, learned Government Advocate, on instructions, submits that Section 63(b) application is posted for enquiry tomorrow i.e. on 25.11.2025 and the pendency of RP No.426 of 2024 will not come in the way of disposal of OA No.7 of 2024.

5. Recording the said submission of the learned Government Advocate, this Writ Petition is disposed of, directing the second respondent to pass final orders in OA No.7 of 2024 on merits in accordance with law within a period of three weeks from the date of receipt of a copy of this order. No costs.
