Prayer : Writ Petition filed under Article 226 of the Constitution of India praying to issue Writ of Mandamus directing the 2^nd respondent to consider the petitioner representation dated 10.6.2025 seeking issuance of a legal heir certificate within a time frame.

ORDER

Mr.P. Ganesan, learned Additional Government Pleader takes notice for respondents. By consent of both the parties, this writ petition is taken up for final disposal at the admission stage itself.

2. The relief sought in this writ petition is a direction to the 2^nd respondent to consider the petitioner’s representation dated 10.06.2025 seeking issuance of a Legal Heir Certificate within a time frame.

3. It is stated that the petitioner is the son of late Manickam and his mother Kalavathi is the first wife of Manickam. It is the case of the petitioner that his father died on 28.05.2025 and thereafter, he had applied for Legal Heirship Certificate in respect of his deceased father with the 2^nd respondent. Subsequently, claiming legitimate legal heir of the deceased Manickam, he submitted a representation dated 10.06.2025 seeking for issuance of Legal Heirship Certificate. Despite the lapse of sufficient time, no orders have been passed so far. In such circumstances, seeking to pursue the said grievance, the petitioner has come up with the present writ petition.

4. Learned counsel appearing for the petitioner that based on the petitioner’s representation, the 2^nd respondent called the petitioner for an enquiry. Further, he submitted that though enquiry was conducted, till date, the said Legal Heirship Certificate was not issued to the petitioner. Hence, he prayed that this Court may issue a direction to the 2^nd respondent to consider the petitioner's representation dated 10.06.2025 seeking issuance of Legal Heirship Certificate, within a reasonable time that may be fixed by this Court.

Learned Additional Government Pleader appearing for the respondents submitted that as the deceased had a subsisting second marriage and the second wife has filed her objections opposing the petitioner’s claim, the petitioner’s application is under process and the Legal Heirship Certificate will be issued only to the eligible legal heirs of the deceased Manickam, Therefore, he prayed for issuance of suitable directions in the above regard.

In view of the limited relief sought for in this writ petition, this Court without expressing any opinion on the merits of the case, directs the 2^nd respondent to consider the petitioner's representation dated 10.06.2025 for issuance of Legal Heirship Certificate and pass orders on merits and in accordance with law, a period of four weeks from the date of receipt of a copy of this order.

7. With the above directions, this writ petition stands disposed of. No costs.
