ORDER
This Writ Petition has been filed directing the first respondent to conclude the enquiry conducted on 24.06.2025, submit the final enquiry report under proceedings Na.Ka.No.12816/23/B4/Sengai dated 10.02.2025 and based on the said report, pass a final order on the Masjid Waqf's representation dated 19.11.2024 seeking approval of the Masjid Waqf's bye-laws, within a time frame fixed by this Hon'ble Court.
2. Heard Mr.H.Thameen Ansari, learned counsel for the petitioner and Mr.Mohammed Fayaz Ali, learned Standing Counsel for the respondents.
3. The petitioner is a registered Waqf (Reg. No.274 of 2024). The Waqf functions under under the Trust Deed dated 24.08.2023. The petitioner gave a representation to the Superintendent of Waqfs, Poonamallee Zone seeking approval of the bye-laws of the petitioner Masjid Waqf. The first respondent, CEO, Tamil Nadu Waqf Board issued directions requesting the third respondent to dispose of the said representation of the petitioner. An enquiry was conducted on 24.06.2025, and the petitioner states that he attended the enquiry, with his advocate and also submitted all relevant documents. However, no final orders have been passed thereafter. It also brought to my notice that the CEO is the competent authority to pass final orders on the representation pending with the Waqf Board. Even though the Waqf Board is not constituted, the enquiry has been conducted by the third respondent, Superintendent of Waqfs, Poonamallee Zone and now the files are with the CEO of the Tamil Nadu Wakf Board, who is required to pass final orders.
4. Considering that the enquiry was conducted as early as in June 2025, I direct the first respondent to dispose of the representation of the writ petitioner dated 19.11.2024 based on the report of the third respondent within a period of eight weeks from the date of receipt of a copy of this order. No costs.
