Respondent PRAYER: Criminal Original Petitions filed under Section 528 of B.N.S.S. to modify condition No.(iii) that the Original R.C. book of the vehicles shall be produced before this Court, if the RC book are required for official purposes, such as the renewal of the permit or obtaining a fitness certificate, the petitioner is permitted to file a petition seeking interim custody of the RC books for that purpose, subsequently the petitioner shall resubmit the RC book before this Court and it shall be kept by this Court until further orders or the disposal of the case, imposed by the Judicial Magistrate-II, Tirupattur in Crl.M.P.No.9584 of 2024 by way of order dated 03.12.2024.

O R D E R

This Criminal Original Petition has been filed to modify the condition No.(iii) that the Original R.C. book of the vehicles shall be produced before this Court, if the RC book are required for official purposes, such as the renewal of the permit or obtaining a fitness certificate, the petitioner is permitted to file a petition seeking interim custody of the RC books for that purpose, subsequently the petitioner shall resubmit the RC book before this Court and it shall be kept by this Court until further orders or the disposal of the case, imposed by the Judicial Magistrate-II, Tirupattur in Crl.M.P.No.9584 of 2024 dated 03.12.2024.

2. It is seen that this petition, seeking modification, has been filed without approaching the Court concerned which passed the order.

Therefore, this Court is not inclined to entertain this petition.

3. Accordingly, this Criminal Original Petition is closed with liberty to the petitioner to approach the Court concerned.
