Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying for issuance of Writ of Mandamus, directing the respondents herein take appropriate action under Section 18 of the Right of Children to Free and Compulsory Education Act 2009 for running the school without recognition and also for appointment of Special Officer to the 6th respondent-school under Section 18 A of the TN. Recognised Private Schools (Regulation)Act.

ORDER

This writ petition has been filed for the following relief :

“directing the respondents herein take appropriate action under Section 18 of the Right of Children to Free and Compulsory Education Act 2009 for running the school without recognition and also for appointment of Special Officer to the 6th respondent-school under Section 18 A of the TN. Recognised Private Schools (Regulation)Act. ”

2. In the counter affidavit filed by the 5th respondent, it has been stated as follows :

“7. I respectfully submit that the Director of School Education has conducted a detailed enquiry into the matter regarding the maladministration, lapses and irregularities of the 6th respondent school. The matter will be decided after giving sufficient opportunity to the existing management and a detailed report will be submitted to the Government for appropriate action as per the provisions in Section 18A of the Tamil Nadu Recognised Private Schools Regulations Act 1973. Such action is in progress. In view of the facts that the Department is taking action with reference to the rules on the management and for appointing a Special Officer which will be done only by the Government, the instant writ Petition has become unnecessary and infructuous and the writ petition is no more maintainable.”

3. Therefore, the learned Government Advocate would submit that orders will be passed after hearing all the interested parties.

4. Recording the same, this Writ Petition stands disposed of. No costs.
