COMMON ORDER

These civil revision petitions are filed challenging the order passed by the Trial court dismissing the applications filed by the petitioners seeking re-

opening of the case and to recall of P.W.1.

2. The petitioners herein filed a suit for declaration and permanent injunction. The plaintiffs' side evidence was already closed and the case was posted for arguments. At this stage, the present applications have been filed petitioners seeking re-opening of the case and recall of P.W.1 for the purpose of marking certain documents. The said applications were dismissed by the Trial Court. Aggrieved by the same, the petitioners have come before this Court.

3. In the affidavit filed in support of the petitions, the petitioners stated that they got certain documents and therefore, the case shall be reopened and P.W.1 shall be recalled. The petitioners have not given the details of the documents they want to rely. Further, they have not filed any petition to receive those pleaded documents. Unless proper application has been filed seeking reception of documents, the question of re-opening of the case for the purpose of marking the documents will not arise. The petitioners have not given any reason in the affidavit regarding the details of the nature of the document and its relevancy for the case. In such circumstances, the Trial Court rightly dismissed the applications. I do not find any error in the impugned common order. Accordingly, the civil revision petitions are dismissed. Consequently, the connected miscellaneous petition is closed. No costs.
