14.Kanchana … Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying for issuance of a Writ of Mandamus, directing the respondents 1 to 8 to consider the petitioner representation dated 20.09.2025 and remove the poultry farm in the residential area.

20.09.2025 and to remove the poultry farm in the residential area.

2. Heard both sides. With the consent of both sides, the writ petition is taken up for hearing at the admission stage itself. Since no adverse order has been passed against the respondent 9 to 14, notice to them is dispensed with.

3. The learned counsel for the petitioner submitted that the respondents 9 to 14 herein are trying to set up a poultry farm without obtaining necessary permission from the official respondents herein in the residential area of the petitioner where there are more than 100 houses, and if the same is established, it would cause health hazards to the residents and hence, in this regard, the petitioner had made a representation dated 20.09.2025, however, there was inaction on the part of the respondents.

Hence, the present Petition.

4. Per contra, the learned Additional Government Pleader for the respondents 2 to 8 on instructions from the Tahsilar, Omalur submitted that the subject farm is only situated in the agricultural zone and the same is protected by fence. He further submitted that there is no residential house as stated by the petitioner but only agricultural wells. Hence, he prayed for dismissal of the petition.

6. Considering the submissions made by the learned counsels on either side and also taking into account that poultry, cattle farms are also part of the agricultural activities, the same cannot be prohibited and therefore, the Writ Petition stands dismissed. There shall be no orders as to costs.
