O RDER

This Writ Petition has been filed challenging the notification issued by the third respondent dated 27.10.2025, thereby notifying applications to be filled up for the post of Health Inspector Grade II in Tamil Nadu Public Health Subordinate Service.

2. Heard the learned counsel on either side and perused the materials available on record.

3. The petitioners are qualified with Diploma in Sanitary Inspector Course awarded by Pondicherry University Community College, Pondicherry. However, the said diploma was not accepted by the Government of Tamil Nadu while recruiting for the post of Multi Purpose Health Worker. Therefore, their Association filed a writ petition before this Court in W.P.No.25673 of 2013 to consider their representation to join them to the post of Health Inspector Grade II and Sanitary Inspector in Government of Tamil Nadu for the existing and immediate future vacancies in the post of Health Inspector Grade II and Sanitary Inspector who are in possession of Diploma in Sanitation Course awarded by the Pondicherry University Community College. This Court, by an order dated 12.11.2013 issued direction and the same was challenged by way of a writ appeal.

4.Pending writ appeal, the Government passed an order in G.O.Ms.No.38 dated 05.02.2016 and the relevant portion of the order is extracted hereunder:-

5. Out of 734 vacancies, already 600 vacancies were filled up in 2014 and

110 vacancies which were reserved for Pondicherry University Community College candidates were not filled up so far. Therefore, the petitioners’

Association were directed to submit a representation by the Division Bench of this Court. However, so far it has not been considered. Hence, this writ petition.

6. Now, the third respondent issued a notification dated 27.10.2025 notifying the applications for recruitment on temporary basis to the post of Health Inspector Grade II for 1429 vacancies.

The learned Additional Government Pleader appearing for the first and second respondents submitted that as directed by this Court as well as in G.O.Ms.No.38 dated 05.02.2016, already 110 posts of Health Inspector Grade II were reserved for Pondicherry University Community College and those vacancies cannot be included in the present notification.

8. The learned Additional Advocate General appearing for the third respondent submitted that 110 vacancies are kept pending till today and those vacancies are not included in the notification dated 27.10.2025.

9. In view of the above, it is clarified that 110 posts of Health Inspector Grade II are kept vacant and it is reserved for Pondicherry University Community College. Further, the respondents are directed to consider the petitioners and other candidates who obtained Diploma in Pondicherry University Community College for appointment to the post of Health Inspector Grade II, within a period of four weeks from the date of receipt of a copy of this order.
