O R D E R

After arguing the case at the length for considerable time and on this Court noticing that the petitioner did not avail the remedy of appeal provided under Rule 28 of CRPF Rules, 1955, the learned counsel for the petitioner seeks permission of this Court to withdraw this petition, with liberty to avail remedy of appeal as provided under the Rules.

2. Though a submission is made on behalf of the petitioner to save the limitation by excluding the period, during which the present petition is pending before this Court, it is noted that the present Writ Petition has been filed on 04.11.2019, while the impugned order is dated 11.01.2018 and the appeal in terms of Rule 28 of CRPF Rules, being required to be filed within 30 days, this Court is of the view that the limitation cannot be saved, in terms of Section 14 of the Limitation Act. However, since, power is conferred with the Appellate Authority to entertain the time barred, appeal by condoning the delay on the said authority deem it fit, in the event the petitioner preferring an appeal and seeking condonation of delay in filing such appeal, the Authority is directed to exclude the period spent by the petitioner in pursuing the present Writ Petition from the date of filing i.e., 04.11.2019 to till date.

3. Subject to the above liberty, this Writ Petition is dismissed as withdrawn. No costs.
