Respondents PRAYER : Petition filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus directing the 4th respondent to appoint an advocate commissioner along with the Government Officials attached to district collector office krishnagiri to inspect the property baimash N.54.1.35.10 situated in the water spread area of Kelavarapalli dam and send a detail report to the higher officials for taking necessary action to pay the compensation etc.

O R D E R

This Writ Petition has been filed seeking a direction to the 4th respondent to appoint an advocate commissioner along with the Government Officials attached to District Collector Office, Krishnagiri to inspect the subject property and send a detailed report to the higher officials for taking necessary action for payment of compensation.

It is the case of the petitioner that his lands have been submerged consequent upon the construction of the Kelavarapalli Dam and therefore, he made a representation dated 01.08.2025 before the 2nd respondent seeking compensation towards the same. Pursuant thereto, an order dated 22.09.2023 came to be passed by the Commissioner of Land Administration, Chennai directing the District Revenue Officer, Krishnagiri to inspect the petitioner’s land to ascertain whether the submersion was attributable to the construction of Kelavarapalli Dam. However, till date no action has been taken in this regard.

Hence, the petitioner has come up with the present Writ Petition.

Learned counsel appearing for the petitioner submitted that, it would suffice, if this Court issues a direction to the Revenue Divisional Officer, Krishnagiri to implement the order passed by the Commissioner of Land Administration dated 22.09.2023 within the time that may be stipulated by this Court.

4. On the above contention, this Court heard the learned Additional Government Pleader appearing for the respondents.

5. The main grievance espoused by the petitioner is that no action has been taken by the District Revenue Officer, Krishnagiri so far pursuant to the order dated 22.09.2023 passed by the Commissioner of Land Administration, Chennai. However, the District Revenue Officer, Krishnagiri is not arrayed as a party to this Writ Petition and therefore, this Court suo-moto impleads the District Revenue Officer, Krishnagiri as the 7th respondent in this Writ Petition. The 7th respondent is directed to implement the order dated 22.09.2023 within a period of twelve (12) weeks from the date of receipt of a copy of this order. 6. This Writ Petition stands disposed of in the above terms. There shall be no order as to costs. Consequently, the connected Miscellaneous Petition stands closed.
