ORDER
This Writ Petition has been filed seeking a direction to the respondents to consider the notional promotion to the petitioners as Forest Guard on par with their juniors, by including their names in the panel drawn for the year 2003 -2004 with effect from 31.05.2004 and in the light of the order passed by this Court in W.P.No.6882 of 2024 dated 14.03.2024 and the proceedings in Se.Mu.No.4058/2024/Pa3 dated 24.12.2024, by considering the petitioners’
representations dated 09.08.2024 and 12.08.2024.
2.Heard the learned counsel appearing on either side and perused the materials available on record.
3.According to the petitioners, similarly placed persons were granted notional promotion pursuant to the orders passed by this Court in the aforementioned writ petition. According to them, if notional promotion is granted, they will be getting enhanced pension. In such circumstances, they submitted representations dated 09.08.2024 and 12.08.2024 to the respondents. Since the representations have not been considered till date, the petitioners have approached this Court by filling the present writ petition.
4.No prejudice would be caused to the respondents, if the petitioners’
representations, as stated supra, are considered on merits and in accordance with law, in the light of the aforementioned orders subject to their applicability.
5.For the foregoing reasons, this Court directs the first respondent to pass final orders on the petitioners’ representations dated 09.08.2024 and 12.08.2024, seeking grant of notional promotion to the post of Forest Guard for the purpose of getting revised petition on par with their juniors, by including their names in the panel drawn for the year 2003-2004 with effect from 31.05.2004. While considering the petitioners’ representations, the first respondent is directed to give due consideration to the order dated 14.03.2024 in W.P.No.6882 of 2024 and the proceedings dated 24.12.2024 in Se.Mu.No.4058/2024/Pa3 and decide whether the same is applicable to the case of the petitioner or not. The first respondent is directed to pass final orders, within a period of twelve weeks from the date of receipt of a copy of this order.
6.With the above directions, this Writ Petition stands disposed of. There shall be no order as to costs.
