PRAYER Writ petition filed under Article 226 of Constitution of India for the issuance of writ of Mandamus Directing the respondents herein to change the petitioners name from P.Bharathpandian to P.Anjana and gender from Male to Transwoman in all academic records including the Transfer certificate, by considering petitioners representation dated 07.10.2025 within a stipulated timeline fixed by this Court.

ORDER

This writ petition has been filed for the issue of writ of Mandamus directing the respondents to change the petitioner’s name from P.Bharathpandian to P.Anjana and the gender from Male to transwoman in all the academic records including the transfer certificate, provisional certificate and Consolidated mark sheet by considering the representation made by the petitioner on 07.10.2025.

2. Heard Mr.B.M.Subash, learned counsel for the petitioner and Mr.S.Sivashanmugam, learned Standing counsel for respondents 1 and 2 and Mr.A.Selvendran, learned Special Government Pleader for 3^rd respondent.

3. The petitioner is a Transwomen. She was born as a Male and she completed her integrated five years Law degree between 2015 to 2020 in the 3^rd respondent college under her birth name P.Bharath Pandian. The petitioner also graduated in the year 2020. The petitioner underwent sex reassignment surgery and altered her physical appearance and gender and reassigned from Male to transwoman in the year 2022. After this process, the petitioner also changed her name from P.Bharath Pandian to P.Anjana. The necessary Gazette Notification was also issued on 12.02.2025.

4. The petitioner thereafter approached the respondents to change her name in the transfer certificate, provisional certificate and also in the consolidated mark sheet. But, however, it was not acted upon. Hence, the petitioner sent a representation on 07.10.2025 to the respondents and the same also did not evoke any response. It is under these circumstances, the present writ petition came to be filed before this Court.

When the matter was taken up for hearing today, Mr.S.Siva Shanmugam, learned Standing Counsel appearing for respondents 1 and 2 based on written instructions received from the 2^nd respondent submitted that the petitioner has not submitted any formal application before the 2^nd respondent seeking for the change of name and gender. If any such application is made by the petitioner, the same will be acted upon and the necessary changes will be incorporated and certificate will be issued to the petitioner within a period of three weeks.

6. In the light of the above submission, there shall be a direction to the petitioner to submit a fresh application before the 2^nd respondent along with all the relevant documents and also a copy of this order. The same shall be acted upon by the 2^nd respondent and the 2^nd respondent shall do the needful within a period of three weeks thereafter.

7. This writ petition is disposed of in the above directions. No costs.
