PRAYER:Appeal filed under Section 100 of the Code of Civil Procedure to set aside the Judgement and Decree dated 30.8.2023 made in CMA.No. 5/2022 on the file of the learned II Additional District Judge, Chidambaram, confirming the Judgement and Decree dated 16.3.2021 made in HMOP.No. 104/2015 on the file of the learned Subordinate Judge Court, Chidambaram.

ORDER

This Civil Miscellaneous Second Appeal has been filed by the appellant challenging the Judgment and Decree dated 30.08.2023 passed in C.M.A. No.5 of 2022 by the learned Additional District Judge, Chidambaram, confirming the Judgment and Decree dated 16.03.2021 made in H.M.O.P. No.104 of 2015 on the file of the Subordinate Judge, Chidambaram.

2.Both the parties appeared before this Court through their respective counsels.

3.Both the parties have entered into a compromise and today, a Joint Memorandum of Compromise dated 12.08.2025 signed by the parties and counter signed by their respective counsels was filed. The said Joint Memorandum of Compromise is taken on file.

4.The appellant paid a sum of Rs.9,00,000/- (Rupees nine lakhs only) by way of a Demand Draft No.563920 dated 01.08.2025 drawn on Indian Bank, Annamalai Nagar, to the respondent and also returned the gold jewels as per the compromise arrived at between them. Accordingly, they have no further claim each other. As per the terms of Compromise, the marriage between the appellant and the respondent solemnized on 09.09.2013 is ordered to be dissoluted. Divorce is granted.

5.The respondent is directed to compound the Criminal case in C.C.No.13 of 2018 on the file of the learned Judicial District Munsif -cum-Judicial Magistrate, Vedasandur. The Trial Court is directed to dispose of the criminal case in C.C.No.13 of 2018 as per the manner known to Law.

6.The Civil Miscellaneous Second Appeal is disposed of on the basis of the Joint Memorandum of Compromise. The terms of Joint Memorandum of Compromise dated 12.08.2025 shall form part of the Decree. No costs.
