ORDER

The present Writ Petition has been filed for the issuance of a Writ of Mandamus, to direct the respondents Nos.2 to 5 to take necessary action to curtail the flow of drainage water into the Nagari Puthukulam Irrigation Kanmai enabling the petitioner's agricultural lands in S.No.344/3B, 32, Thanichiyam Revenue Village, Vadipatti Taluk, Madurai District, comprised in Patta No.1417 is feasible for carrying out agricultural activities in light of the communication made by the second respondent to the fourth respondent in Na.Ka.No.0762/2024/A4 dated

06.05.2025 and to provide compensation to the petitioner within a time stipulated by this Court.

2. The petitioner is the owner of agricultural land situated in S.No.344/3B, 32. The sixth respondent is the Panchayat Secretary. The petitioner has submitted several representation to respondents 5 and 6 to take action against the letting of drainage water into the petitioner's agricultural land. Such drainage is affecting the petitioner's agricultural activities. Despite several representation, the official respondents failed to take action. Hence, the present writ petition has been filed.

The learned Special Government Pleader appearing for the respondents 1 to 5, on instructions, submitted that the petitioner's representation is under consideration and that a proposal has been made to put up a channel. It is further submitted that necessary administrative sanction has been obtained and a work order has been issued for putting up channel, so that the drainage water will be diverted away from the petitioner's agricultural land. The said submission is recorded.

4. This Court is strictly directing the official respondents to put up the channel within a period of three months from the date of receipt of a copy of this order. The official respondents are directed to implement the scheme for putting up soak pits in the residences of the said area. Further, the official respondents are directed to ascertain the feasibility of establishing a recycling plant so that the recycled water may utilized for agricultural land for agriculture purposes. In case, if the drainage water is let into the petitioner's agricultural land, the petitioner shall be entitled to compensation in accordance with law.

5. With the above said directions, this Writ Petition is disposed of. There shall be no order as to costs.
