ORDER

The present writ petition has been filed to direct the second respondent to provide electricity connection to the petitioner's premises at No.10/38F, Neelikaran Street, Thiruvottiyur, Chennai-600 019 by considering his representation dated 27.11.2025

2. It is the case of the petitioner that he is in possession and enjoyment of first floor of the premises at No.10/38F, Neelikaran Street, Thiruvottiyur, Chennai-600 019. According to the petitioner, his father purchased the said property in the name of his mother by way of a registered sale deed dated 27.07.1990 and petitioner and petitioner's brother were living in the said property along with their mother and the petitioner constructed a house in the said property by spending Rs.20,00,000/-. When things stood thus, there was a dispute between them and suits are also pending between the parties. It is submitted that as the electricity connection is in the name of the petitioner's mother, she is often disconnecting the service connection and creating disturbance to the petitioner's enjoyment. Hence, the petitioner applied for electricity connection before the second respondent on 27.11.2025, but the same is pending without no action. Hence, the present writ petition.

3. Mr.L.Jai Venkatesh, learned Standing counsel appearing for the respondents submitted that there are civil suits pending between the parties and the application of the petitioner will be considered within a period of two months.

4. This Court has carefully considered the submissions made on either side and perused the materials available on record.

5. This Court makes it clear that mere providing of electricity connection will not in any manner confer any right to the occupant of the property. If there is any objection, the respondents can consider granting electricity connection subject to the result of the civil suits which is said to have been pending between the parties.

6. In view of the above, there shall be a direction to the respondents to consider the application submitted by the petitioner on 27.11.2025, process the same after collecting necessary fees from the petitioner and proceed to provide electricity supply to the petitioner after he executing the indemnity bond. The above exercise shall be completed within a period of two months from the date of receipt of a copy of this order. It is made clear that the electricity supply given to the petitioner does not in any way confer any right to the petitioner over the property.

This writ petition is disposed of with the above directions. No costs
