JUDGMENT

This Civil Miscellaneous Appeal had been preferred against the common judgment in F.C.O.P.No.55 of 2016 and G.W.O.P.No.10 of 2015 and M.C.No.26 of 2015 on the file of the Family Court at Erode, vide dated 20.12.2016 and more specifically filed against the observations in G.W.O.P.No.10 of 2015.
2. The said Guardians and Wards Original Petition has been filed, seeking custody of the minor daughter of the appellant and the respondent herein, who was born on 27.11.2007.
3. By the common judgment, the custody was given to the appellant herein and the respondent/mother was granted visitation rights.
4. It is to be noted that the learned counsel for the respondent is not present.
5. The learned counsel for the appellant, however, stated that the respondent/mother never exercised that right. It is further contended that now the daughter had attained the age of majority and has also joined a professional course. Since, she had attained the age of majority, she is in a position to take a decision of her own and a guardian is not required.
6. In view of that particular fact, the Civil Miscellaneous Appeal No.3240 of 2017 is dismissed as infructuous. However, there shall be no order as to costs.
