ORDER
The apprehension of the petitioner in this writ petition is that based on the fourth respondent’s application, the official respondents may survey and demarcate the property morefully described in the affidavit filed in support of this writ petition, without hearing the petitioner’s objections.
2. The petitioner claims that he has a right over the property, and hence, his objections will have to be heard by the official respondents before the survey and demarcation is done.
3. Mr.S.Arumugam, learned Government Advocate, accepts notice on behalf of the respondents 1 to 3. Since no adverse orders are passed against the fourth respondent, notice to the fourth respondent in this writ petition is dispensed with.
4. The learned Government Advocate appearing for the official respondents brought to the notice of this Court the order dated 28.08.2025 passed in a writ petition, i.e., W.P.No.31268 of 2025, filed by the fourth respondent herein, as well as the notice given by the Tahsildar to the petitioner herein pursuant to the aforesaid order, and would submit that the petitioner has already been put on notice about the survey and demarcation of the boundaries of the subject property. However, the learned counsel for the petitioner would submit that till date, the petitioner’s objections have not been considered by the Tahsildar.
5. No prejudice will be caused to the official respondent if the survey and demarcation of the boundaries of the subject property is done based on the fourth respondent’s application after giving due consideration to the petitioner’s objections, within a time frame to be fixed by this Court. Accordingly, this writ petition is disposed of by directing the respondents 1 and 2 to consider the application of the fourth respondent seeking for survey and demarcation of the boundaries of the subject property, after hearing objections of the petitioner, and in strict compliance with the order dated 28.08.2025 passed in W.P.No.31268 of 2025 filed by the fourth respondent herein. The respondents 1 and 2 are directed to complete the aforesaid exercise within a period of 12 weeks from the date of receipt of a copy of this order. No Costs.
