ORDER

This writ petition has been filed for a mandamus to direct the second respondent to open and run the TASMAC retail vending shop No.959 morefully described in the schedule to the affidavit filed in support of this writ petition, based on the proceedings of the first respondent dated 10.10.2025, within a time frame to be fixed by this Court.

2. The petitioner is the landlord of the subject property. He has entered into an agreement with the second respondent for opening of a TASMAC shop in his property. The first respondent through his proceedings dated 10.10.2025 permitted opening of the said TASMAC shop in the property owned by the petitioner. However, till date, the TASMAC shop in the subject property is yet to be opened. In such circumstances, the petitioner has filed this writ petition.

3. Mr.V.Manoharan, learned Additional Government Pleader, accepts notice on behalf of the first respondent. Ms.Saranya, learned standing counsel, accepts notice on behalf of the second respondent.

No prejudice will be caused to the respondents if the petitioner’s grievance for opening of the TASMAC shop in his property morefully described in the schedule to the affidavit filed in support of this writ petition is considered on merits and in accordance with law, based on the proceedings of the first respondent dated 10.10.2025 permitting the opening of the TASMAC shop, within a time frame to be fixed by this Court. Since there is no written representation given by the petitioner to the respondents prior to the filing of this writ petition, the petitioner has to give a representation to the respondents for the purpose of opening of the TASMAC shop in the subject property. The learned counsel for the petitioner on instructions also stated that the petitioner is willing to give a representation to the respondents for opening of the TASMAC shop based on the proceedings of the first respondent dated 10.10.2025.

For the foregoing reasons, this writ petition is disposed of by directing the petitioner to submit a representation to the respondents requesting to open a TASMAC shop in the property morefully described in the schedule to the affidavit filed in support of this writ petition, based on the proceedings of the first respondent dated 10.10.2025, within a period of one week from the date of receipt of a copy of this order. On receipt of the said representation, the respondents shall consider the same on merits and in accordance with law, within a period of four weeks thereafter. No Costs.
