Writ Petition filed under Article 226 of the Constitution of India praying for issuance of Writ of Mandamus, directing the respondents to consider and pass orders on the appeal dated 09.05.2025 submitted by the petitioner under Patta Passbook Act requesting to cancel the patta No.166 and issue a fresh patta modifying the same by adding all the legal heirs of the previous patta holder in respect of the lands in Survey No.325/47 of Kaniyampadi Village, Vellore Taluk & District.
ORDER
This Writ Petition has been filed seeking for a limited relief. The petitioner seeks for an early disposal of her appeal dated 09.05.2025, pending on the file of the 1st respondent.
Aggrieved by the order of the 2nd respondent, the petitioner has filed the appeal dated 09.05.2025. Since the said appeal is yet to be disposed of, the petitioner seeks for an early disposal of the same in this writ petition.
Mr.R.P.Murugan Raja, learned Government Advocate, accepts notice on behalf of the respondents.
No prejudice would be caused to the respondents, if a direction is issued to the 1st respondent to dispose of the appeal, dated 09.05.2025, within a time frame to be fixed by this Court. This Court is not expressing any opinion on the merits of the petitioner’s appeal.
For the foregoing reasons, this Writ Petition is disposed of, directing the 1st respondent to pass final orders on the petitioner’s appeal, dated 09.05.2025, on merits and in accordance with law, within a period of twelve (12) weeks from the date of receipt of a copy of this order, by adhering to the principles of natural justice. No costs.
