Prayer :
Writ Petition filed under Article 226 of the Constitution of India praying for issuance of Writ of Mandamus, forbearing the respondent authorities from cancelling the patta issued infavour of the petitioner without following due process of law by considering the petitioner’s representation dated 09.10.2025.
ORDER
The apprehension of the petitioner in this writ petition is that the petitioner’s patta may be cancelled by the respondents. Therefore, she seeks for a direction from this Court that only by due process established under law and after giving an opportunity of hearing to the petitioner, the proposal to cancel the patta bearing No.599 can be considered.
2. Mr.D.Ravichander, learned Special Government Pleader, accepts notice on behalf of the respondents.
3. No prejudice would be caused to the respondents, if a direction is issued to them to issue notice to the petitioner and hear the objections of the petitioner before proceeding to cancel the petitioner’s patta bearing No.599.
4. Learned counsel for the petitioner, on instructions, would also submit that the petitioner is satisfied if the aforesaid direction is issued by this Court to protect the interest of the petitioner.
5. Accordingly, this Writ Petition is disposed of by directing the respondents, in case they decide to cancel the petitioner’s patta bearing No.599, to issue notice to the petitioner and hear her objections, and only thereafter, they shall decide as to whether petitioner’s patta as stated supra can be cancelled or not. No costs.
