Prayer: Writ Petition filed under Article 226 of the Constitution of India,

praying for issuance of a Writ of Mandamus, directing the respondents 1 to 3

to release the teaching grant-in-aid to these writ petitioners from the date of

25.11.2019 to 31.10.2022 i.e., the date of their approval of appointment as

Assistant Professors in respective department as per the UGC Norms in the

fourth respondent college by the second respondent vide proceeding

Na.Ak.No.25485/F3/2021 dated 12.05.2022 and consequential order of the

third respondent vide proceeding in Na.Ka.No.1174/E1/2021-2 dated

01.09.2022 and disburse salary for all purpose including monetary benefits

by considering proposal of the fourth respondent dated 12.08.2025, within a

time frame as stipulated by this Court.

This Writ Petition has been filed seeking a direction to the respondents

1 to 3 to release the teaching grant-in-aid to the petitioners herein from the

date of 25.11.2019 to 31.10.2022 i.e., from the date of their approval of

appointment as Assistant Professors in the respective departments as per the

UGC Norms in the fourth respondent College by the second respondent vide

proceeding Na.Ak.No.25485/F3/2021 dated 12.05.2022 and the

consequential order of the third respondent vide proceeding in

Na.Ka.No.1174/E1/2021-2 dated 01.09.2022 and to disburse salary for all

purpose including monetary benefits by considering the proposal of the

fourth respondent dated 12.08.2025, within a time frame as fixed by this

Court.

2. Heard the learned counsels on either side. With the consent of both

sides, the Writ Petition is taken up for hearing at the admission stage itself.

3. The brief facts of the case is as follows:

3.1. The petitioners are appointed as Assistant Professors in the

Departments of Tamil, English, History, Botany, Zoology, Chemistry and

Mathematics respectively in the fourth respondent college on 25.11.2019 for

the vacancies that arouse in the sanctioned posts due to retirements. The

proposal sent by the fourth respondent for disbursement of grant-in-aid

towards their salary to the third respondent on 24.03.2021 was denied by the

third respondent vide proceedings dated 19.04.2021 on the ground that no

prior permission was obtained before filling up the posts. The fourth

respondent filed W.P.(MD) No.13195 of 2021, wherein several identical

issues have been relied upon by the fourth respondent college and taking

note of all the referred decisions, this Court held that the college authorities

shall not be insisted upon prior approval for appointment of the teaching

staff in the minority institutions, which is squarely applicable to the present
