PRAYER: Criminal Original Petition is filed under Section 482 of Criminal Procedure Code, to direct the respondents not to harass the
petitioners and their family under the guise of enquiry.

The present Criminal Original Petition has been filed seeking a direction to the respondent police not to harass the petitioners and their family members under the guise of enquiry.
2. The learned counsel appearing for the petitioners submitted that the petitioners are the father, mother, brother and sister-in-law of one Revathi, who was married to one Vignesh. After five years of marriage, the said Revathi passed away and the said Vignesh had returned her jewels to her parents. Subsequently, he had given a complaint stating that the petitioners have forcibly taken the jewels from him. He had voluntarily given the jewels and now, he is complaining as if the jewels were taken under threat and based on the complaint, the respondent police are harassing the petitioners to return the jewels.
3. The learned Government Advocate (Criminal Side) appearing for the respondents submitted that based on the complaint given by the said Vignesh, the respondent Police are conducting an enquiry in C.S.R.No.2507 of 2025 and that the petitioners were called only for enquiry and were not harassed during the enquiry.
4. Such being the position, it is for the Investigating Agency to issue appropriate notice to the petitioner under Section 35(3) of BNSS for enquiry and on receipt of such notice, the petitioner shall appear for enquiry and co-operate in the investigation. It is made clear that the petitioner shall not be harassed during the course of enquiry. If any cognizable offence is made out, the respondent Police shall register a First Information Report and proceed in accordance with law within a period of two weeks from the date of receipt of a copy of this order.
5. Accordingly, this Criminal Original Petition stands disposed of.
