Government Advocate - - - - - - ORDER The relief sought in this writ petition is a -direction to the respondents 1 to 5 to consider petitioner’s representation dated 25.02.2023 and to take action against the 7th respondent including the departmental action and other appropriate legal proceedings, within a stipulated period.
2. The case of the petitioner is that the petitioner’s grandfather vz., Ponmalai Chettiar had purchased the agricultural land to an extent of 1.69 cents in S.No.187/1 at Ulundur Village. After his death, the petitioner’s father viz., Venkatesan had enjoyed the said property by transferring the patta in his favour. Thereafter, he sold 1 Acre out of 1.69 cents for the welfare of the family and the remaining 69 cents was in possession of the petitioner’s father. While so, the petitioner’s brother viz., Kalyanasundaram by furnishing false information, as if oral partition took place in which property pertaining to the aforesaid Survey Number was allotted to him, had executed the General Power of Attorney in favour of one K.Ayupkhan and based on which, the said K.Ayupkhan executed a Sale Deed in favour of his son-in-law namely Gulam Mohammed and the same was registered in the office of the 7th respondent on 04.02.2022 as Doc.No.742/2022. In this regard, the petitioner made a representation to the respondents 1 to 5 on 25.02.2023. As the same did not evoke any response, the petitioner has come forward with this writ petition seeking for the aforesaid relief.
3. Learned counsel appearing for the petitioner would submit that the 7th respondent by colluding with the said Ayupkhan had registered the fraudulent Sale Deed with respect to the subject property. He therefore prays for a direction to the respondents 1 to 5 to pass orders on the representation of the petitioner.
4. Learned Additional Government Pleader appearing for the respondents submitted that the petitioners’ representation dated 25.02.2023 will be considered by the 2nd respondent and appropriate orders will be passed, on merits and in accordance with law.
5. In view of the limited relief sought for in this writ petition, this Court without expressing any opinion on the merits of the case, directs the 2nd respondent to consider the petitioner's representation dated 25.02.2023 and pass orders on merits and in accordance with law, as expeditiously as possible.
6. With the above directions, this writ petition stands disposed of. No costs.
