Prayer: Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus forbearing the respondents from interfering with the petitioner’s peaceful possession and enjoyment of the property situated in Survey Nos.214/3, 4 and Nos.219/1, 2, Nolambur Village, Ambattur Taluk, Tiruvallur District, except under due process of law.

The writ petition has been instituted to forbear the respondents from interfering with the petitioner’s peaceful possession and enjoyment of the property situated in Survey Nos.214/3, 4 and Nos.219/1, 2, Nolambur Village, Ambattur Taluk, Tiruvallur District, except under due process of law.

2. The nature of relief as such sought for in the present writ petition is not entertainable. Actions are initiated for removal of encroachment by the authorities and such a writ petition is filed seeking a direction not to interfere with the peaceful possession of the property. The property right is to be established by approaching competent civil Court of law. This blanket relief as such sought for, in the present writ petition would cause prejudice to the competent authorities to invoke the provisions of law for eviction of encroachments. Therefore, the Writ Petition stands dismissed. No costs.
