PRAYER : Criminal Miscellaneous Petition filed under Section 528 of Bharatiya Nagarik Suraksha Sanhita, Act, 2023, the modify the condition directing the petitioners to execute a bond for Rs.1,00,000/- each with two sureties each surety shall execute a bond for like sum, out of the two sureties, one surety must be a blood relative or a family member of the petitioners, as imposed in Crl.M.P.No.15742 of 2025 in C.C.No.2294 of 2025 dated 18.11.2025 on the file of the Additional Chief Metropolitan Magistrate,

Egmore, Chennai.

ORDER

This Criminal Miscellaneous Petition has been filed by the petitioners

seeking modification of the condition directing the petitioners to execute a bond for Rs.1,00,000/- each with two sureties each surety shall execute a bond for likesum, out of the two sureties, one surety must be a blood relative or a

family member of the petitioners, as imposed in Crl.M.P.No.15742 of 2025 in C.C.No.2294 of 2025 dated 18.11.2025 on the file of the Additional Chief Metropolitan Magistrate, Egmore, Chennai.

2. when the matter taken up for hearing today, the learned counsel for the petitioners submitted that directing the petitioners herein to execute a bond for a sum of Rs.1 lakh, and directing the petitioners to execute two sureties and one surety must be a blood relation of the petitioner, is onerous. Hence, he prays to modify the same.

3. The learned Government Advocate (Crl.Side) submitted that the case involved herein is misappropriation of several crores hence, the trial Court has rightly directed the petitioner to execute a bond for a sum of Rs.1 lakh and one surety must be a blood related one. Hence, he opposed to grant bail to the petitioners.

4. I have also gone through the order passed by the learned Additional Chief Metropolitan Magistrate, Egmore Chennai.

5.Considering the facts and circumstances of the case and also considering the misappropriated amount involved in this case, this Court is of the view that, directing the petitioners to execute a bond for sum of Rs.1 lakh is not an onerous condition. However, considering the difficulty raised, this Court is inclined to modify the condition that the sureties need not be a blood related surety.

6. Accordingly, the condition imposed on the petitioners in Crl.M.P.No.15742 of 2025, dated 18.11.2025 by the learned Additional Chief Metropolitan Magistrate, Egmore, Chennai is modified and the same is read as follows:

“The petitioners/Accused No.2 and 3 are directed to execute a bond for Rs.1,00,000/- each with two sureties, each surety shall execute a bond for like sum, and both sureties are produced means document with satisfaction of this Court.” It is made clear that the other conditions imposed on the petitioner vide order dated 18.11.2025 in Crl.M.P.No.15742 of 2025, shall remain unaltered.”

7. Accordingly, this Criminal Miscellaneous Petition stands modified.
