PRAYER : Criminal Miscellaneous Petition filed under Section 483 (1) (b) of Bharatiya Nagarik Suraksha Sanhita, Act, 2023, to modify the bail condition imposed by the Principal Special Court for NDPS & EC Act Cases, Chennai in Crl.M.P.No.7350 of 2025 dated 25.11.2025, by substituting the requirement of

“one blood surety” with “two local sureties”.

ORDER

This Criminal Miscellaneous Petition has been filed by the petitioner

seeking modification of the bail condition imposed by the learned Principal Special Judge, Special Court for NDPS & EC Act Cases, Chennai in Crl.M.P.No.7350 of 2025 dated 25.11.2025, by substituting the requirement of

“one blood surety” with “two local sureties”.

2. The learned counsel for the petitioner submitted that the petitioner was granted bail by the learned Principal Special Judge, Principal Special Court under EC & NDPS Act, Chennai – 104 with some conditions and in one of the condition that “the petitioner is ordered to be released on bail, on executing a bond of Rs.10,000/- (Rupees Ten Thousand only) with two sureties for a like sum each to the satisfaction of the learned V Metropolitan Magistrate, Egmore. One among the sureties should be a blood surety”. He further submitted that the petitioner's family members are residing outside Chennai and he has only his mother and his mother is unable to travel due to medical, financial of employment constraints due to which, the petitioner was unable to comply with the said condition. Hence, he prays to modify the same.

3. Considering the aforesaid facts and circumstances of the case, this Court is inclined to modify the bail condition imposed on the petitioner in Crl.M.P.No.7350 of 2025, dated 25.11.2025, passed by the learned Principal Special Judge, Special Court under EC & NDPS Act Cases, Chennai, as follows:

“The petitioner /Accused is ordered to be released on bail, on executing a bond of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties each for a like sum each to the satisfaction of the learned V Metropolitan Magistrate, Egmore.”. It is made clear that the other conditions imposed on the petitioner in Crl.M.P.No.7350 of 2025, dated

25.11.2025, shall remain unaltered.

4. Accordingly, this Criminal Miscellaneous Petition stands modified.
